Client: Sri Lankan male who is working as a chef in a restaurant in Osaka. He has been in Japan for 8 years. He has a monthly income of 250,000yen. Case: As his life in Japan has become steady, he would like to invite his family members to live with him in Japan. The status for family members is the Dependant Status. But you must keep in mind that according to the Immigration Law, those considered dependant are only the spouse and the children. Although parents, brothers and sisters are considered dependant family members when getting a deduction on tax payments, this does not go for the immigration law. The children do not have to be under age. They can be adults, as long as they are dependant on their parents, which also means that the Dependant status is not a working visa, so all those under the Dependant visa are not allowed to work. The Dependant status is given to most family members of the working visa holders’, except for Diplomat, Official, Short-term, Pre-colleged, Trainee, and Designated Activities status holders. Also the Dependant status is permitted for the family of the Student visa holders. But as we have mentioned, Dependant status holders are not allowed to work. So they must prove that either they are being sent enough money to make a living, or they have enough savings. Of course, the Student visa holders are allowed to have a part time job, as long as they are granted the special permission to engage in activities other than their current status. For working visa holders, there is no specific amount of salary stated because there are limits just to obtain the visa itself. For instance, for interpreters, it is stated that one has to be earning more than 250,000yen per month. Our client is a chef, so he falls under the Engineer status. No specific amount is stated for the Engineer status’s income. It just says that one must be paid an equal amount of his/er Japanese colleague. Documents needed: 1. Documents to prove the relationship with the family *Family registrations, Marriage Certificate, Birth Certificates, etc. 2. Certificate of Employment 3. Certificate of Proof of payment of taxes (Nouzei shoumeisho) 4. Withholding slip This procedure is called the Application for Certificate of Eligibility |
