First of all, let’s review the conditions. His wife is also a foreign citizen, so his wife and children fall under the dependant status. The age of the in laws are not specified but they are healthy.

In this case, they would probably apply for the Designated Activities status. This status is permitted to those whose “activities which are specifically designated by the Minister of Justice for foreign individuals”. An example of this is, for instance foreigners who would like to come to Japan for medical treatment. There is no status of resident for “medical treatment” or “patients”. But if the Minister of Justice judges that this person may come to Japan, this foreigner will be granted the “Designated Activities”. In short those who fall under the Designated Activities status are those who do not fall under any other category of the status of resident.

Our client will fall under this category also. They would apply for the Designated Activities, being the family of an Investor status holder.

What makes this case difficult to be permitted is that both of the in-laws are still up and well. The Minister of Justice may assume that since the in-laws can look after each other in their home country, there is no desperate need for them to come to Japan. They may judge that the in-laws will be well off, just if the client transfers money to them. Also, we do not know the in-laws age, but if they are under 60, it maybe even harder.

Looking on the bright side, the client is running his business very well in Japan, which can become a very good point. They should also appeal that it is best for the whole family to live together in a rich environment like Japan.
