Inviting a third chef

Client:
A Sri Lankan restaurant owner. At the moment he has two chefs working for him.

Case:
He would like to know if he can invite a third chef over.

The most important thing in this case is to convince the immigrations to understand why you need another chef to help you out.

Since we do not have any other information on our clients restaurant, like if he is planning to open a new branch, or he is going to extend the closing time we have to talk under assumption.

If for instance, our client has no intention in expanding his business and just wants another chef, there is a low chance of the immigrations allowing the visa. This is because the immigrations would think that he has enough chefs as is.

On the other hand, if he is able to prove that he has more than 10 tables for four, and he has hundreds of customers coming in and out to enjoy, he definitely needs more than 2 chefs. In this case he would have a high chance of inviting another chef over.

According to the Labor Standards Law an employer must make sure that his/her employee works within 40 hours a week, and no more than 8 hours a day. If the restaurant has a large number of customers everyday, and it means that the current chefs cannot handle them within the legal working hours, that would become a reasonable excuse for inviting another chef over.

Another case we can think of is if our client intends on extending the open hours, hoping to increase the sales. This would mean longer hours for the chefs, and two may not be enough to serve all the customers. But if this is just a matter of increasing the sales, our client must keep in mind that the expenses would increase as well.

This is because the foreigner must be paid the same or more than the salary a Japanese colleague is paid. That would probably be somewhere around 200,000yen for one employee per month. Just to give you an estimate, from Mr. Nakano's experience, at a very small restaurant, one was paid 180,000yen.

Not only the condition of the restaurant, but also there are conditions for the one to be invited to clear. One of them is that he/she must have 10 years or more experience. For chefs who are from a country where licenses and certificates are issued, they should have it with them when applying. But they also need a written document that proves that one has 10 years or more experience.

Recently, fake certificates are being made so you have to look out for those. Especially it seems easy to issue a certificate from a restaurant that the applicant has been working for 10 years or more, because it is quite difficult for the immigrations to find out if the restaurant really existed or not. In this case the immigrations will ask the embassy or consulate in the country to find out about the restaurant, so be ware.
